Access to participant accounts and their information is exclusively held by ERS administrators, ensuring that personal data is securely managed and not accessible to unauthorized individuals.

Participant Responsibilities:
Participants are expected to provide accurate, truthful, and up-to-date information when filling out the application form for research studies. It is the responsibility of the participant to ensure the information they provide reflects their current situation, qualifications, and interests accurately. Participants must also adhere to the guidelines and instructions provided for each research session they partake in, including any preparatory requirements and the respectful exchange of feedback.

Prohibited Activities:

Proprietary Rights

All content, features, and functionality (including but not limited to information, software, text, displays, images, video, and audio) on the ERS platform are owned by ERS, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, and other intellectual property or proprietary rights laws.

License Grant to Participants:
ERS grants participants a limited, non-exclusive, non-transferable license to access and participate in research studies conducted through the ERS platform. This license is solely for the purpose of enabling participants to provide valuable feedback and insights to researchers in accordance with the terms outlined by ERS.

Restrictions on Use of Materials:
Participants may not copy, reproduce, redistribute, sell, or exploit for any commercial purposes any part of the ERS services or access to the ERS services. The use of the content on the ERS platform for any purpose not expressly permitted by these Terms is strictly prohibited.

Privacy and Data Use

ERS collects personal information from participants solely for the purpose of matching them with suitable research studies and facilitating the research process. Distribution and Redemption of Incentives:

Cancellation Fees and Refunds:
In the event that a research session is canceled by the researcher or ERS in an event where participants invested their time, participants may be eligible for a cancellation fee as compensation for their time. This fee is determined on a case-by-case basis. Participants who are unable to attend a scheduled research session are required to notify ERS as soon as possible. Failure to do so may result in the participant being ineligible for future studies. Refunds of incentives are not applicable, as incentives are only awarded upon completion of a research session.

Participant Conduct

Participants are expected to conduct themselves professionally during research sessions. This includes being punctual, providing honest and thoughtful feedback, and respecting the guidelines set forth by the researcher. Participants should be prepared to engage fully in the session, having reviewed any preparatory materials provided in advance.

Prohibited Information and Actions:
Participants are strictly prohibited from sharing confidential or proprietary information that they do not have the right to disclose. This includes, but is not limited to, personal financial information, passwords, and sensitive personal data. Participants are also prohibited from engaging in any behavior that disrupts the research session, including the use of offensive language, harassment of researchers or other participants, and attempting to manipulate the research outcomes.

Confidentiality Obligations:
Participants may be exposed to confidential or proprietary information during a research session. Participants are obligated to keep such information confidential and may not disclose or use it for any purpose outside of the research session. This obligation extends beyond the duration of the research session and remains in effect indefinitely.

Dispute Resolution

Initial Dispute Resolution Process:
Should a dispute arise between a participant and ERS, the parties will first attempt to resolve the issue informally. Participants are encouraged to contact ERS directly with any concerns or issues that may arise, allowing ERS the opportunity to address and resolve the dispute promptly.

Binding Arbitration Agreement:
If the dispute cannot be resolved informally, participants agree to resolve any claims relating to these Terms or the Services through final and binding arbitration, rather than in court. This arbitration will be conducted by a neutral arbitrator and not in a class, consolidated, or representative action.

Class Action Waiver:
Participants waive any right to participate in class actions, class arbitrations, or any other representative action or proceeding. By agreeing to these Terms, participants agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

As such, we reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, including the availability of any feature, database, or content. ERS will endeavor to provide notice of significant changes to the Services that could materially affect participants' use.

Notification of Changes:
ERS will provide notice of significant changes to these Terms or the Services through the Services themselves, via email, or through other communication channels deemed appropriate. It is the responsibility of participants to regularly review these Terms and stay informed of any changes. Continued participation in research sessions following any modifications signifies acceptance of the revised Terms.

Termination

Grounds for Termination:
Participants may have their access to the Services terminated by ERS for any breach of these Terms, including but not limited to, failure to comply with the conduct guidelines, providing false or misleading information, or failure to fulfill the obligations agreed upon when applying for a project.

Effects of Termination:
Upon termination, participants will lose access to their accounts and the ability to participate in future research sessions. Any pending incentives or payments may be forfeited unless otherwise determined by ERS in its sole discretion.

Account Deactivation Process:
Participants wishing to deactivate their account may do so by contacting ERS directly through the provided contact information. ERS will guide participants through the deactivation process, which will include the removal of personal information from our databases in accordance with our Privacy Policy and applicable legal requirements.

Legal Disclaimers and Limitations of Liability

Disclaimer of Warranties:
ERS provides the Services on an "as is" and "as available" basis without any warranties of any kind, whether express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. ERS does not guarantee that the Services will be free of errors, secure, or uninterrupted.

Limitation of Liability:

General Provisions

Governing Law and Jurisdiction:
The Terms of Use for participants in Easy Research Studies (ERS) services shall be governed by and construed in accordance with the laws of the jurisdiction where ERS operates, without giving effect to any principles of conflicts of law. Participants agree that any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in the jurisdiction of ERS's operation and consent to the personal jurisdiction and venue therein.

Complete Agreement and Severability:
These Terms, along with any additional terms or policies referred to and incorporated herein by reference, constitute the entire agreement between participants and ERS regarding the Services. If any provision of these Terms is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect, and the unenforceable provision will be deemed modified to the extent necessary to render it enforceable while preserving its intent.

No Waiver:
The failure of ERS to enforce any right or provision of these Terms will not constitute a waiver of such right or provision unless acknowledged and agreed to by ERS in writing.
